Who is this form for?

  • This claim application is intended for people who believe they are eligible to make a claim against a bond posted by a Group 4 independent school. Students may claim against the bond for the prorated repayment of fees when courses were not taken or completed by a student as a result of the closure of an independent school or the suspension or cancelation of the independent school’s Group 4 certification.

Purpose of a Group 4 Independent School Bond:

  • In order to be certified as an independent school, Group 4 independent schools are required to maintain a bond. The bond is held by the Province and is intended to provide for the prorated repayment to students of all fees when courses are not taken or completed by students as a result of a school closing or the suspension or cancelation of the independent school’s Group 4 certification. See the Ministry of Education Group 4 Independent School Bonding Policy for more information.

Notes:

  • Group 4 bonds are not intended to provide 100% reimbursement of fees for impacted students. Rather, the bond is intended to provide a prorated repayment of fees. Repayment can be a lengthy process that must comply with certain legislative timelines. This process will not provide immediate prorated repayment to families.

  • Claims may only be made for prorated repayment of fees within the limitation period. The limitation period is defined as two years following the end of the school year (June 30) in which the school closed, and the bond was required to be maintained. This means that depending on the month of the school closure, the end of the limitation period will fall between 2 and 3 years from the date on which the school closed. For additional clarification on the “limitation period”, refer to the definitions section of the Group 4 Independent School Bonding Policy.

  • June 30, 2027, marks the end of the limitation period for the bond posted for Phoenix Magnet Academy, a B.C. independent school located at 3190 University Boulevard, Squamish, B.C. and operated by Global Impact Education Corporation.

  • The length of time for this process is designed to ensure equity among all potential claimants and to ensure that all claimants have an equal opportunity to submit a claim.

  • The Ministry of Education and Child Care will not begin to assess claims for prorated repayment of fees until after June 30, 2027, after the end of the limitation period.

  • Assessment of claims will be conducted as quickly as possible and progress updates will be provided. The timeline for the ministry’s subsequent claim review and refund administration process will depend on a variety of factors, including the number and complexity of the claims.

  • Former students who were not able to enter Canada due to immigration issues (e.g. rejected study permit) not related to the school closure are not eligible for prorated refund from the bond.

  • Submission of this claim application does not guarantee any repayment of fees.

  • The ministry may verify refunds previously paid by the former school authority.

  • Repayment from the bond will only be considered in relation to courses scheduled to begin after July 1 in the year of the school closure and for which the student never received a final grade. For Phoenix Magnet Academy this means that prorated repayment will only be considered for courses scheduled to begin after July 1, 2024, for which the student never received a final grade from the school authority.

  • Claims will be assessed without the provision of identification documents, but repayments will require proof of identification.

  • Be advised that submitting false information may invalidate a claim.

  • No claims will be accepted after June 30, 2027.

  • All documents submitted must be in English, using English language characters. A notarized translation (the notary must be a practising lawyer, or a member of The Society of Notaries Public of British Columbia) must be submitted along with the original in instances where documentation is in a language other than English.

  • Complete one claim application and attach supporting documents for each student’s claim.

  • All claim applications must include a unique, six-digit identification number provided by the Ministry of Education and Child Care. Please contact the Independent Schools Office (contact details below) if you do not yet have a number.

  • When submitting documents, only submit information that is required. If, for example, you are submitting a bank statement as evidence of tuition paid, please ensure that you redact (black out) any information that is not required, e.g. bank account details, bank balance, other transactions, social insurance number, etc.

  • The claim form will only accept files up to 20MB total. If you are unable to submit the claim form due to a large number of attachments, please send an email with any additional attachments via email at EDUC.IndependentSchoolsOffice@gov.bc.ca with your claim number in the subject line.

  • The claimant must complete, sign and submit this application. If the claimant is under the age of 19 at the time of form submission, then the application (this form) must be submitted and signed by the parent/guardian. NOTE: A claim that has been submitted by a minor (i.e. former student who is less than 19 years of age at the time of signing and submission of the application) is not a valid claim.

  • Please note that the claimant will receive a confirmation email. The confirmation email will be sent to the email address provided on the submission firm. If you do not receive a confirmation email, please contact the Independent Schools Office.

Communications

  • The ministry will communicate with claimants via email.

  • It is the claimant's responsibility to keep the ministry informed of any changes to their contact details.

  • If ministry communications to the claimant at the contact information provided (e.g. requests for clarifications on claim application, payment instructions etc.) are not acknowledged/responded to within 12 weeks of the date of the ministry communication, then the claimant's claim will be closed, and a refund may not be provided.

Refund procedures (eligible claims only):

  • Refunds will be provided by electronic funds transfer (ministry's preferred method of repayment) or by cheque.

  • Information required for electronic funds transfer will be requested after all of the applications have been reviewed and only if the claim is eligible for refund.

  • If cheque is the method of repayment, it will be mailed to the address provided by the claimant in this application.

Collection Notice:

  • Documents and information related to this claim, its investigation and/or resolution will be treated in confidence and will not be disclosed to any person not involved in the matter unless disclosure is necessary for the processing and investigation of this claim or is required by law. The Independent Schools Office is subject to the provisions of the Freedom of Information and Protection of Privacy Act (FOIPPA).

  • The Ministry of Education and Child Care is collecting this information as a designate of the Ministry of Finance under s. 4 of the Bonding Act for the purpose of administering the bond under the Bonding Act and providing prorated repayment to students of fees under s. 12(5) of the Independent School Regulation.
